Notification of corporate domains before the Public Record

In fulfillment of the arranged in the art. 9 of the Law 34/2002, of July 11, of Services of the Information society and of Electronic commerce (LSSICE) establishes the obligation of:

To legalize the corporate names of domain before the corresponding Public Record.

It supposes that if you, in his quality of company or natural person and with the object of acquiring juridical personality, are inscribed in certain public record and are an owner of a domain or Internet address that it uses to offer his services through the network, he will have to communicate the above mentioned domain to this record.

For example: the mercantile societies will have to communicate the above mentioned fact to the Mercantile Record, so that any interested person could consult and know with all confidence the direction of the web page of every company.

All those companies that had operating in the network, before the coming into effect of the LSSICE (October 12, 2002) must communicate this fact to the corresponding record, before October 14, 2003. If you have not done it, we recommend to him to do it as soon as possible. In any case any company that a web page should publish after the coming into effect of the LSSICE (October 13, 2002) will have to communicate the name of the domain that it should have registered for this end in the course of one month from his securing.

Likewise the term to communicate the replacement and cancellation of the name of domain that should be notified is one month from the replacement or cancellation of the same one.

To fulfill this obligation, it is necessary to request information to the corresponding record, considering the disparity of criteria of the different records as for the way of carrying out it.

The nonperformance of this obligation is contemplated by the LSSICE as light infraction, article 38.4 and 39 and can be sanctioned by fine of up to 30.000€
